Abstract

The purpose of this study are to: (1) identify the essence of ‘nagari adat’ (customary village)(2)explain internal and external factors that challenge and threaten communities of customary law, and (3)initiate a model of protection of the traditional village (nagari) from the legal and human right aspects. This research used R & D(research and develoment)method. This study was located in two areas of “darek” (land); Agam and 50 Kota, and twoareas of “rantau” (shore); Pesisir Selatan and PadangPariaman. The data was processed with qualitative methods. The result shows that: (1) the essence of Minangkabau’s nagari customary villages remains visible in customary law as evidenced by the presence of: customary institution and law, justice system, natural resources management, social structure, and the nagari administration, (2)the internal factors that challenge and threaten communities of customary law are quality of human resources and values inheritance system, meanwhile external factors include problems from the local administration and investors, and (3)the protection model of the nagari customary village is implemented for customary institution, territories of customary law, justice system, natural resources management, social structure, and Nagari administration such as creating nagari protection bill in the local legislators. This study recommends the protection and fulfillment nagari customary village by KAN (Kerapatan Adat Nagari)court, while ‘Jorong/Korong/koto’ (administrative unit under nagari) become the centre of administration.
